State Level RTI: Uttar Pradesh


Background

Until recently, Uttar Pradesh did not have a comprehensive access to information law. However, on 3 April 2000, the Uttar Pradesh Government issued Executive Orders establishing the Code Of Practice On Access To Information to provide some level of access to information to citizens. The Code was issued as interim measure to ensure access to information to people.

The Code was intended to apply relatively comprehensively, including government offices, corporations, councils, public sector undertakings, directorates, Boards, local bodies and tax commissioners within its scope, as well as contractors or agencies which carried out functions on behalf of a public body. However, on 25 March 2000, the State Ministerial Committee on Economic Development decided to make the Code applicable only to the Public Works Department, Department of Agriculture and the Tax and Consolidation Department as the first stage of implementation. It does not appear that any steps have been taken since to extend the application of the Code.

Law

In May 2005, the national Right to Information Act 2005 was passed by Parliament. The RTI Act 2005 received Presidential assent on 15 June and came fully into force on 12 October 2005. The RTI Act 2005 covers all Central, State and local government bodies and applies to the State Government of Uttar Pradesh.

Second Appeals and complaints against non-disclosure of information may be filed with the Uttar Pradesh State Information Commission.
